Terms of Use

These Terms of Use govern your use of Class Scrambler, a web-based tool that helps teachers and schools allocate students into classes.
Class Scrambler is provided by Noko Labs (“Noko Labs”, “we”, “us” or “our”).
By using Class Scrambler, you agree to these Terms of Use. If you do not agree with them, please do not use the service.
1. About the service
Class Scrambler allows a user to upload a student roster, define classes and allocation preferences, automatically allocate students between classes, make manual adjustments and export the resulting class lists.
The service is provided as a decision-support and administrative tool. You remain responsible for reviewing and approving every allocation before using it for school purposes.
Class Scrambler does not make admissions, placement, educational, disciplinary or other decisions on behalf of a school.
2. Authorised use
Class Scrambler is intended primarily for teachers, school administrators and other persons who are authorised to work with student information.
By uploading or entering information into Class Scrambler, you confirm that:
- you are authorised to use that information for the purpose for which you are using Class Scrambler;
- your use complies with your school's policies and any applicable confidentiality, privacy and data-protection requirements; and
- you will not use Class Scrambler for an unlawful purpose.
Students should not use the service to upload information about other students unless specifically authorised to do so by their school.
3. Student information and local processing
Class Scrambler is designed so that student roster information, class configurations, allocation constraints and resulting allocations are processed locally in your browser.
The core Class Scrambler workflow does not require a user account or database, and student data is not intended to be transmitted to or stored on Class Scrambler's servers. The application does not use cookies, local storage, session storage or similar browser storage to retain roster or allocation information. Information in the working session is discarded when the page is refreshed or closed.
You should nevertheless:
- only upload information that is reasonably necessary for class allocation;
- avoid including sensitive information that is not needed for the allocation process;
- ensure that exports are saved, shared and stored securely; and
- follow your school's own information-security and records-management requirements.
Once you export a workbook from Class Scrambler, you are responsible for that exported file and how it is subsequently stored, transmitted or used.
4. No saved projects or session recovery
Class Scrambler does not currently provide user accounts, saved projects or session recovery.
If you close or refresh your browser before exporting your work, your roster, constraints and allocation may be lost.
You are responsible for maintaining any records that your school requires.
5. Reviewing allocations
Class Scrambler attempts to produce balanced class allocations while applying the instructions and constraints entered by the user, including class-size limits, “keep together”, “keep apart” and pre-assignment rules.
Some combinations of requirements may be impossible to satisfy. Where this occurs, Class Scrambler may display warnings or flags explaining unresolved conflicts or constraints.
You must review:
- the resulting class lists;
- all displayed warnings or conflicts;
- class sizes;
- manual changes; and
- the exported workbook
before relying on the allocation.
Do not assume that an allocation is correct merely because Class Scrambler generated it.
6. Acceptable use
You may use Class Scrambler for legitimate educational and administrative purposes.
You must not:
- attempt to interfere with, disable or circumvent the service's security controls;
- use automated tools to overload or abuse the service;
- attempt to access systems, functions or data that you are not authorised to access;
- introduce malicious code or files;
- use the service in a way that violates applicable law or the rights of another person;
- misrepresent Class Scrambler as making a decision that is legally or professionally required to be made by a teacher, school or other responsible person; or
- use the service to intentionally discriminate against, harm or unfairly target students.
We may restrict access to the service where reasonably necessary to protect Class Scrambler, its infrastructure or other users.
7. Uploaded spreadsheets and exports
Class Scrambler accepts supported spreadsheet formats solely for the purpose of reading roster information in the user's browser.
The application is designed to treat uploaded spreadsheets as data rather than executable content and to reduce spreadsheet-formula injection risks in exported files.
You remain responsible for ensuring that files you upload are lawful, appropriate and obtained from a trusted source.
8. Suggestions and feedback
Class Scrambler may provide an optional form through which you can submit feedback, suggestions or bug reports.
Information entered into this form is transmitted to us so that the message can be delivered. The suggestion feature is separate from the student-allocation workflow.
Do not include student names, student records or other confidential school information in the suggestion form.
If you submit an idea, suggestion or other feedback about Class Scrambler, you give us permission to use that feedback to improve the service without compensation or obligation to you.
9. Availability and changes to the service
Class Scrambler is provided free of charge.
We may update, modify, suspend or discontinue some or all of the service at any time.
We do not guarantee that Class Scrambler will always be available, uninterrupted, error-free or compatible with every browser, device or spreadsheet file.
10. Intellectual property
Class Scrambler, including its software, interface, branding, documentation and other original materials, is owned by or licensed to Noko Labs and is protected by applicable intellectual-property laws.
These Terms give you permission to use the service. They do not transfer ownership of the service or its intellectual property to you.
You retain ownership of information that you enter or upload.
11. Disclaimers
Class Scrambler is provided “as is” and “as available.”
To the maximum extent permitted by law, we make no warranty that:
- an allocation will be suitable for a particular school or educational purpose;
- every user instruction or constraint can be satisfied;
- the service will operate without interruption or error; or
- an exported file will remain compatible with every spreadsheet application.
Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
12. Limitation of liability
To the maximum extent permitted by applicable law, Noko Labs will not be liable for indirect, incidental, special or consequential loss arising from the use of, or inability to use, Class Scrambler.
In particular, we are not responsible for decisions made by a school or user based on a Class Scrambler allocation, or for the subsequent loss, disclosure or misuse of an exported file after it has left the Class Scrambler application.
Nothing in these Terms limits liability where it would be unlawful to do so.
13. Third-party services
Class Scrambler relies on third-party infrastructure and services to operate certain limited functions, including web hosting, security verification and delivery of suggestion messages.
Those services may be subject to their own terms and privacy practices.
The core student-allocation process is designed to occur in the user's browser rather than through those third-party services.
14. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Namibia.
Any dispute relating to these Terms or Class Scrambler will be subject to the jurisdiction of the courts of Namibia, except where applicable law provides otherwise.
15. Changes to these Terms
We may update these Terms from time to time.
When we make material changes, we will update the “Last updated” date shown above. Continued use of Class Scrambler after updated Terms take effect constitutes acceptance of the revised Terms.
